Last updated: 03 September 2026
Welcome to learning.connemara.co.za, operated by Connemara Consulting (Pty) Ltd, a company based in Illovo, Johannesburg, South Africa. These Terms of Use govern your access to and use of the Website and the purchase and use of Harvard ManageMentor courses made available through the Website.
By accessing the Website, creating an account, or purchasing an Offering, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or purchase any Offering. These Terms should be read together with our Privacy Policy.
1. Our Relationship with Harvard Business Impact
Connemara is a licensed provider of Harvard ManageMentor and related Harvard Business Impact learning products across Africa, hereafter referred to as “HBI”. This means:
- HBI owns and/or licenses all intellectual property, content, trademarks and course materials associated with the Offerings, including the Harvard ManageMentor name and logo;
- Connemara has been authorised by HBI to make certain Offerings available for purchase and use by customers in the African market, subject to the terms of a separate agreement between Connemara and HBI;
- when you purchase an Offering through the Website, you are entering into a commercial relationship with Connemara for the purchase and access arrangements described in these Terms. You are not purchasing directly from HBI, and Connemara does not own the underlying HBI content, trademarks or intellectual property; and
- nothing in these Terms should be understood as Connemara claiming ownership of, or an unrestricted right to deal with, any HBI intellectual property beyond what is expressly permitted by our agreement with HBI.
Where any provision of these Terms depends on the specific wording of our licensing agreement with HBI, that provision should be treated as subject to confirmation against that agreement (see the Legal Review Checklist at the end of these Terms).
2. Definitions
“Account” means a user profile created to purchase and access Offerings via the Website.
- “Offering(s)” means any Harvard ManageMentor course or other Harvard Business Publishing/Harvard Business Impact learning product made available for purchase on the Website.
- “User”, “you” or “your” means any person who accesses the Website or purchases an Offering.
- “Content” means all course materials, text, video, audio, assessments, templates, graphics and other material made available as part of an Offering.
- “HBI” means as Harvard Business Impact, the owner or licensor of the Offerings and their associated Intellectual property.
- “Website” means learning.connemara.co.za or any related pages or platforms operated by Connemara through which the Offerings are made available.
- “Terms” means these Terms of Use, as updated from time to time, together with any documents incorporated into them by reference
3. Eligibility and User Accounts
To purchase an Offering, you will generally be required to create an Account. In relation to your Account, you agree to:
- provide accurate, current and complete information during registration and keep that information up to date;
- keep your login credentials confidential and not share them with any other person;
- notify us promptly at info@connemara.co.za if you become aware of any unauthorised use of your Account; and
- accept responsibility for all activity that occurs under your Account, except to the extent caused by our fault.
Accounts are intended for individual use. We do not currently offer organisational or group accounts for purchase through the Website; organisations wishing to arrange access for multiple employees should contact us directly at info@connemara.co.za to discuss suitable arrangements outside of the standard online checkout.
We may suspend or terminate an Account where these Terms are breached, in accordance with Section 16 (Suspension and Termination) below.
4. Course Access and Licence
Subject to your payment of the applicable fee and compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable licence to access and use the relevant Offering for your own individual learning purposes.
Purchasing an Offering does not transfer any ownership in the Content to you. All Content remains the property of HBI (or its licensors) and is protected by copyright and other intellectual property laws. Your right to access an Offering is a licence to use it under these Terms, not a sale of the Content.
Course access is available for a period of six (6) months from the date of purchase, unless otherwise stated at the point of purchase for a specific Offering. Access will lapse automatically at the end of this period, and no extension or refund will be provided in respect of unused access, except where required by law.
Unless expressly stated otherwise for a specific Offering, you may not:
- share your Account credentials or Offering access with any other person;
- copy, reproduce, download (other than through normal use of the platform), print, or store Content outside of the platform on which it is delivered;
- distribute, republish, resell, sublicense, rent or lend access to any Content;
- create derivative works based on the Content, or use the Content to develop competing training materials or products;
- remove, obscure or alter any copyright, trademark or other proprietary notice contained in the Content;
- use any automated means (including scraping, crawling or bulk downloading tools) to extract Content or data from the Website or the learning platform; or
- input, upload or otherwise use Content within any artificial intelligence or machine learning system, including for the purpose of training such a system, without HBI’s prior written consent.
We may monitor use of the Offerings to ensure compliance with this Section and may take any appropriate action where a breach is identified, including suspending access to any licences obtained under this Section.
5. Prohibited Use of the Website
In addition to the restrictions in Section 4, you agree not to use the Website to:
- engage in any unlawful, fraudulent or misleading activity;
- misrepresent your identity or affiliation with any person or organisation;
- attempt to gain unauthorised access to any Account, system or network connected to the Website;
- interfere with, disrupt or place an undue burden on the Website, its servers, or connected networks;
- introduce any virus, malware or other harmful code;
- infringe the intellectual property, privacy or other rights of Connemara, HBI or any third party; or
- engage in any conduct that could reasonably damage, disable or impair the Website, or the reputation of Connemara or HBI.
We reserve the right to investigate suspected breaches of this Section and to take any lawful action we consider appropriate, including suspension of access, termination of an Account, and, where necessary, referral to law enforcement.
6. Purchases, Pricing and Payment
Prices for Offerings are displayed on the Website in South African Rand (ZAR) and are inclusive of value-added tax (VAT) where applicable, as Connemara is a VAT-registered vendor. While ZAR is our primary transaction currency, we are able to receive payment in USD and GBP; where you pay in a currency other than ZAR, the amount charged may be subject to currency conversion by our payment provider, and any related fees or exchange rate variance are outside our control.
Payments are processed through PayFast, a third-party payment service provider. By making a payment, you also agree to PayFast’s applicable terms and privacy practices. We do not store your full payment card details.
An order is accepted, and a binding sale concluded, once payment has been successfully processed and confirmed by our payment provider. We will provide confirmation of your purchase and, where applicable, instructions for accessing the Offering.
We take reasonable care to ensure that prices and course descriptions on the Website are accurate. However, in the event of an obvious pricing or descriptive error, we reserve the right to correct the error, cancel the affected order, and refund any amount paid, before granting access to the relevant Offering.
If a payment is declined, reversed, charged back, or reasonably suspected to be fraudulent, we reserve the right to suspend or withdraw access to the relevant Offering until the matter is resolved.
We may, from time to time, offer discounted or promotional pricing on certain Offerings. Promotional pricing applies only for the period stated and does not apply retroactively to earlier purchases.
7. Refunds and Cancellations
Given the nature of digital learning content, and because access to an Offering is typically granted immediately upon successful payment, our position is as follows:
- No refunds: Purchases of Offerings are non-refundable once payment has been processed and access granted. As the offerings consist of digital content to which access is made available immediately, you expressly request and consent to access commencing as soon as your payment is confirmed. You also acknowledge that the seven (7) day cooling off right under sec44 of the Electronic Communications and Transactions Act 25 of 2002 does not apply once access has begun.
- Course changes: if you wish to change the specific course purchased, you may request this by emailing info@connemara.co.za within twenty-four (24) hours of your original purchase. Requests made after this period may not be accommodated.
- Duplicate or erroneous charges: if you believe you have been charged in error, or charged more than once for the same Offering, please contact info@connemara.co.za promptly so that we can investigate and correct the matter.
- Technical issues: if you are unable to access an Offering you have paid for due to a technical fault on our part or that of our platform provider, contact info@connemara.co.za and we will work to restore access; where access cannot reasonably be restored, we will consider an appropriate remedy on a case-by-case basis.
Nothing in this Section is intended to exclude any statutory right you may have under the Consumer Protection Act 68 of 2008 or other applicable consumer protection legislation, to the extent such legislation applies to your purchase and cannot lawfully be excluded by agreement.
8. Certificates of Completion
A Certificate of Completion will be issued once you have completed the required coursework and achieved a minimum score of 80% in the associated assessment. Certificates are issued for your personal record and do not constitute a professional qualification, accreditation, or guarantee of competency beyond the scope of the specific Offering completed.
9. Third-Party Services and Links
The Website may make use of, or link to, third-party services, including payment processing platforms e.g PayFast, website hosting, the learning management platform on which Offerings are delivered, analytics, email delivery, and customer support tools. These third parties operate under their own terms of use and privacy policies, which we encourage you to review.
We are not responsible for the content, functionality, or practices of third-party services, or for any loss arising from your use of them, Your use of third-party services is at your own risk and subject to those third parties’own terms of use and privacy policies
10. Website and Platform Availability
We aim to keep the Website and the platform on which Offerings are delivered available and functioning correctly, but we do not guarantee uninterrupted or error-free access. Availability may be affected by scheduled maintenance, technical faults, internet or network issues, or circumstances outside our reasonable control, including outages of third-party platforms on which the Offerings depend.
Where reasonably practicable, we will provide advance notice of planned maintenance that is likely to affect your access.
11. Intellectual Property
Connemara materials: the Website’s design, layout, original text, graphics, and Connemara’s own branding and trademarks are owned by or licensed to Connemara and may not be copied, reproduced or used without our prior written consent.
HBI materials: all Offerings, course Content, the Harvard ManageMentor name, and associated HBI trademarks and logos are owned by, or licensed to, HBI. Your use of these materials is governed by the licence described in Section 4 and does not grant you any ownership interest.
Third-party materials: certain elements of the Website or an Offering may incorporate material owned by other third parties, used under licence. Such material remains the property of its respective owner.
12. Educational Nature of the Offerings
The Offerings are educational and professional development resources. Completion of an Offering does not guarantee any particular outcome, including career advancement, promotion, employment, business performance, financial results, or specific professional competence. Any decisions you or your organisation make based on the Content are made at your own discretion and risk.
13. Disclaimers and Limitation of Liability
To the maximum extent permitted by applicable law:
- the Website and Offerings are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, save as expressly stated in these Terms or as required by law;
- we do not warrant that the Website or Offerings will be uninterrupted, error-free, or free of harmful components;
- we will not be liable for any indirect, incidental, or consequential loss (including loss of profit, business or opportunity) arising from your use of, or inability to use, the Website or an Offering, except where such loss arises from our gross negligence, wilful misconduct, or fraud. Our total aggregate liability to you arising out of or in connection with these Terms or any Offering, from all causes of action and whether in contract or otherwise is limited to the total amount actually paid by you for the Offering giving rise to the claim.
- nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded, including liability arising under the Consumer Protection Act 68 of 2008 for loss caused by our gross negligence or for defective goods or services, where applicable.
This Section should be reviewed by a South African attorney to confirm it is appropriately balanced and enforceable for our specific business (see Legal Review Checklist).
14. Privacy
Personal information collected through the Website is handled in accordance with our Privacy Policy, and applicable data protection legislation, including the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy forms part of, and should be read together with, these Terms.
15. Communications and Marketing
We will send you transactional communications relating to your purchase, Account, and Offering access (such as order confirmations, access instructions, and important service notices) as these are necessary to provide the Offerings to you.
We may also send you marketing communications about our products and services, where you have consented to receive these or where otherwise permitted by applicable law. You may opt out of marketing communication at any time using the unsubscribe mechanism provided, or by contacting info@connemara.co.za.
16. Suspension and Termination
We may suspend or terminate your Account, or restrict your access to an Offering, where:
- you breach these Terms;
- we reasonably suspect fraudulent, abusive, or unlawful conduct connected to your Account; or
- we are required to do so by HBI under our licensing arrangement, or by applicable law.
On termination of your Account for any reason, your licence to access the relevant Offering(s) ends immediately. Provisions of these Terms which by their nature ought to survive termination, including intellectual property, limitation of liability, and governing law, will continue to apply. Termination does not affect any payment obligations already incurred.
17. Changes to These Terms
We may update these Terms from time to time, including to reflect changes in our business, our agreement with HBI, or applicable law. Where we make material changes, we will take reasonable steps to notify users, such as posting a notice on the Website or updating the “Last updated” date above. Continued use of the Website following such changes constitutes your acceptance of the updated Terms. Purchases made prior to a change will generally be governed by the Terms in force at the time of purchase, unless applicable law requires otherwise.
18. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa.
Any dispute arising from these Terms or your use of the Website will be subject to the following: The parties will first attempt in good faith to resolve the dispute by negotiation; failing resolution within thirty(30) days, the dispute will be subject to the non-exclusive jurisdiction of the courts of South Africa
Customers located outside South Africa should note that certain consumer protections in their own country of residence may also apply to their purchase; this should be confirmed with legal counsel where the Website is actively marketed into a specific jurisdiction.
